Use of the website signifies your unconditional agreement to these Terms & Conditions ("Terms") and to be bound by these Terms, as well as all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. Aloha Resume reserves the right, at its sole discretion, from time to time, to change, modify, add or remove any portion of these Terms, in whole or in part, at any time.

1. Use License

Permission is granted to temporarily use Aloha Resume's website for personal, non-commercial transitory viewing only. Aloha Resume LLC grants you a non-exclusive, non-transferable, subscription-based license to use the Aloha Resume platform on a monthly basis. There are no limitations on the number of devices the software can be installed on. This is the grant of a license, not a transfer of title, and under this license, you may not:

• Modify or copy the source materials;
• Attempt to decompile or reverse engineer any software contained on Aloha Resume's website;
• Remove any copyright or other proprietary notations from the materials; or
• Transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions or other terms of these Terms, including but not limited to non-payment or unintended use of the platform, and may be terminated by Aloha Resume at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

You hereby agree to defend, indemnify and hold harmless Aloha Resume, and all its officers, directors, agents, employees, information providers, affiliates, licensors and licensees from and against any and all liabilities, claims, penalties, losses, damages, cost and expense (including court costs and reasonable attorney’s fees, interest expense and amounts paid in compromise or settlement), suits or actions arising out of or resulting from any breach by you of these Terms, including the foregoing representations, warranties and covenants. You shall cooperate as fully as reasonably required in the defense of any claim.

5. Accuracy of Materials

The materials appearing on Aloha Resume's website could include technical, typographical, or photographic errors. Aloha Resume does not warrant that any of the materials on its website are accurate, complete, or current. The Site may contain hypertext links and pointers to the other World Wide Web Internet sites and resources operated and controlled by parties other than Aloha Resume. Links to and from the Site to such third party sites do not imply or constitute an endorsement by Aloha Resume of any third party material or contents and Aloha Resume does not assume any responsibility or liability for said third party material or contents. Aloha Resume may revise these Terms of Service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these Terms of Service.

7. Subscription Terms

Aloha Resume sells subscription access to our platform on a calendar month basis. The subscription period runs from the start date until the corresponding day of the following month or the closest day of the month. Recurring subscriptions automatically renew unless they are canceled via a method described in the Service at least 24 hours before the end of the current subscription period.

8. Refund Policy

Aloha Resume offers a refund policy as follows:

• Refunds: Refunds are available only for the first month of subscription and must be requested within 7 days of the initial subscription date. Refund requests made after this period will not be granted.
• How to Request a Refund: To request a refund, please contact our customer support at support@aloharesume.com with your account details and reason for the refund request.
• Non-refundable Situations: Refunds will not be provided for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account.

9. User Representations and Responsibilities

By accessing or using the Aloha Resume platform, you represent the following and agree to the following responsibilities:

1. You are responsible for maintaining the confidentiality of your login information and for complying with all usage policies of the Aloha Resume platform. You agree not to share your account with others.
2. You shall not share your account or login credentials with others, reverse engineer, decompile, or disassemble the software, or use the platform for any purpose that is illegal or prohibited by this EULA.
3. You agree that you will not claim any intellectual property rights over the software or content.
4. You represent, warrant and covenant that you will not upload, post or transmit to or distribute or otherwise publish through the Site any materials which: (i) restrict or inhibit any other user from using and enjoying the Site; (ii) are unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, offensive, pornographic, profane, sexually explicit or indecent; (iii) constitute or encourage conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law or governmental regulation; (iv) violate, plagiarize or infringe the rights of third parties including, without limitation, copyright, trademark, patent, rights of privacy or publicity or any other proprietary right; (v) contain a virus or other harmful or destructive elements; (vi) contain any information, software or other material of a commercial nature; (vii) contain advertising of any kind; or (viii) constitute or contain false or misleading indications of origin or statements of fact.
5. You acknowledge that Communications involving the Site are not confidential and that Communications may be read or intercepted by others. You acknowledge that by submitting Communications to Aloha Resume, no confidential, fiduciary, contractually implied or other relationship is created between you and Aloha Resume other than pursuant to these Terms.
6. By posting messages, uploading files, inputting data or engaging in any other form of communication (individually or collectively "Communications") to the Site, you hereby grant to Aloha Resume a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty free license to use, copy, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, edit and otherwise fully exploit such Communications, in all media now known or hereafter developed. You hereby waive all rights to any claim against Aloha Resume for any alleged or actual infringements of any proprietary rights, rights of privacy and publicity, moral rights and rights of attribution in connection with such Communications.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, USA, without regard to its conflict of law provisions.

11. Dispute Resolution

Any disputes arising out of or related to these Terms shall be resolved through binding arbitration in the State of Wisconsin, USA. You and Aloha Resume LLC agree to submit to the personal and exclusive arbitration of any disputes relating to your use of the Site under the rules of the American Arbitration Association. Any such arbitration, to the extent necessary, shall be conducted in Pardeeville, Wisconsin. You covenant not to sue Aloha Resume LLC in any other forum.

12. Entire Agreement and Waiver

These Terms, as well as any Privacy Policy or applicable Subscription Agreement referenced herein, constitutes the entire agreement between Aloha Resume and you with respect to your use of and access to the Site. These Terms supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between you and Aloha Resume with respect to the Site. Use of the Site is unauthorized in any jurisdiction that does not give effect to all of the terms and conditions of these Terms. A printed version of these Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms or the Site to the same extent and subject to the same conditions as other business documents and records generated and maintained in printed form by Aloha Resume. The failure of Aloha Resume to enforce any provision of these Terms shall not be deemed a waiver of such provision nor bar Aloha Resume’s right to enforce the provision.
